Auto Rickshaw driver asks for Adhaar from migrant laborer, slaps him



Thiruvananthapuram/Kerela: An Incident took place on February 21 where an auto driver repeatedly slapped a migrant laborer and asked for his Adhaar for questioning his rash driving. The video of this incident went viral on social media.
The driver, Suresh, was arrested on the complaint of the laborer Gautam Mandal (25), a native of West Bengal, by the Vizhinjam police officials on Sunday. The laborer was claiming of being assaulted by the driver at Mukkola in Vizhinjam, Kerela. 
Incident took place when the laborer was about to enter the mobile-recharge shop and he was hit by the auto-rickshaw. On mentioning, that he was hit by the reversing auto, the driver got angry. He got down from rickshaw to walk towards the migrant. He started slapping the laborer and asking him for his Adhaar Card or any ID Card. 
In the captured video at the spot by a resident, Suresh was seen pulling the laborer's Adhaar Card from his wallet and slapping him with using abusive language. He told Gautam that he would get his card back from the Commissioner's office. "Let me go to the Commissioner's office and check if there are any cases registered in your name, then you will get your card back." Suresh is heard saying this in the video.
Soon after the video went viral and filed an FIR against Suresh, local Police took him into custody before he could abscond. He was arrested under section 294(b) (of sings, recites or utters any obscene song, ballad or words, in or near any public place), Section 341 (of punishment for wrongful restraint), Section 506 (punishment for criminal intimidation), Section 323 (punishment for voluntarily causing hurt) and Section 308 (attempt to commit culpable homicide) of the Indian Penal Code(IPC).
Sherief George, a witness said that Suresh started intimidating and attacking Gautam allegedly without any provocation. Though Gautam did not retort immediately.
The witness added that a few minutes prior to the incident, Suresh was involved in an argument with another person whose two-wheeler allegedly collided with his auto-rikshaw.
On saying by relatives of Suresh that he had mental problems, police asked for suitable documents to prove their claims. 
Suresh is a drug addict and frequently gets into scuffles. He does not have gave criminal records but has a few minor cases of abusing people, said locals.
